Terms and Conditions

1. Introductory Provisions

1.1 These business terms and conditions (hereinafter referred to as the "Terms and Conditions") of the company BEITELI, s.r.o., with its registered office at Tiskařská 599/12, 10800 Prague 10, identification number: 27384551, registered with the Trade Licensing Office, Municipal District of Prague 9 (hereinafter referred to as the "Seller"), regulate, in accordance with Section 1751, paragraph 1 of Act No. 89/2012 Coll., the Civil Code, the mutual rights and obligations arising from a purchase contract (hereinafter referred to as the "Purchase Contract") concluded between the Seller and a natural person (hereinafter referred to as the "Buyer") through the Seller's online store at www.fannifen.online (hereinafter referred to as the "Website").

1.2 The Terms and Conditions do not apply to legal entities or persons acting within their business or independent profession.

1.3 Provisions deviating from the Terms and Conditions may be agreed in the Purchase Contract and take precedence.

1.4 The Terms and Conditions are an integral part of the Purchase Contract. The Purchase Contract is concluded in the Czech language.

1.5 The Seller may amend or supplement the Terms and Conditions without affecting rights during the validity of the previous version.

2. User Account

2.1 Registration allows the Buyer to access a user account to order goods. Ordering is also possible without registration.

2.2 The Buyer must provide accurate and truthful information and update it if it changes.

2.3 Access to the user account is secured by username and password. Confidentiality must be maintained.

2.4 The Buyer may not allow third parties to use the account.

2.5 The Seller may cancel accounts inactive for over 36 months or in case of breach of contract.

2.6 The Buyer acknowledges the account may be temporarily unavailable due to maintenance.

3. Conclusion of the Purchase Contract

3.1 Product presentations are informative; the Seller is not obliged to conclude a contract for all displayed goods.

3.2 Product information includes prices (VAT included) and applicable fees.

3.3 Shipping and packaging costs within the Czech Republic are indicated.

3.4 To order, the Buyer fills out the order form specifying products, payment, delivery method, and associated costs.

3.5 Before sending the order, the Buyer may review and correct information. Orders are sent by clicking "Complete Order". Receipt is confirmed by email.

3.6 The Seller may request additional confirmation of the order.

3.7 The contract is concluded upon the Seller's order acceptance email.

3.8 The Buyer bears costs of communication (internet, phone) when using remote communication methods.

3.9 Shipping destinations: Slovakia, Germany, Poland. Delivery methods, times, and costs are in the Shipping Policy.

4. Price of Goods and Payment Terms

4.1 Payment methods: Cash on delivery (COD), card payment.

4.2 Prices include VAT; shipping costs are charged unless otherwise stated.

4.3 No deposit required unless stated otherwise.

4.4 Payment due upon delivery for cash/COD; non-cash payment due within 5 days.

4.5 Non-cash payment is fulfilled when the amount is credited to the Seller's account.

4.6 The Seller may require full payment before shipment if necessary.

4.7 Discounts cannot be combined.

4.8 Tax invoices are issued electronically after payment.

5. Withdrawal from the Purchase Contract

5.1 Withdrawal is not possible for personalized goods, rapidly perishable goods, goods sealed for hygiene reasons if unsealed, or damaged audio/video/software packaging.

5.2 Otherwise, the Buyer may withdraw within 14 days from receipt. Withdrawal must be sent to Podleská 1521/7B, 104 00 Prague – Uhříněves or info@fannifen.cz. A sample withdrawal form is provided as an appendix.

5.3 Returned goods must be sent within 14 days. Buyer bears return costs unless agreed otherwise.

5.4 Refunds are processed within 14 days using the same method as original payment.

5.5 The Seller may offset compensation claims for damaged goods.

5.6 Seller may withdraw from the contract before delivery; purchase price will be returned immediately.

5.7 Gifts provided with the goods must be returned if the purchase contract is withdrawn.

6. Transportation and Delivery of Goods

6.1 Special transport requested by the Buyer is at the Buyer's risk and cost.

6.2 Buyer must accept goods at delivery.

6.3 Re-delivery or alternate delivery requested by Buyer is at Buyer's expense.

6.4 Buyer must inspect packaging upon receipt and notify carrier of any damage.

6.5 Special delivery conditions may apply.

6.6 Typical delivery times: Slovakia 3–4 business days (Zásilkovna), Germany & Poland 3–5 business days depending on courier. Fees and methods shown at checkout.

7. Rights from Defective Performance

7.1 Rights and obligations governed by Civil Code Sections 1914–1925, 2099–2117, 2161–2174, and Consumer Protection Act No. 634/1992 Coll.

7.2 Seller guarantees goods are defect-free at receipt and conform to agreement or reasonable expectations.

7.3 Exceptions: goods sold at lower price due to defects, normal wear, used goods matching prior wear.

7.4 Defects within 6 months are presumed to exist at receipt. Consumer claims valid within 24 months.

7.5 Claims handled at Seller’s business premises or registered office.

7.6 Further rights regulated by Seller's complaints procedure.

8. Other Rights and Obligations

8.1 Ownership transfers upon full payment.

8.2 Seller is not bound by any codes of conduct under §1826 Civil Code.

8.6 Seller operates under trade license; data protection supervised by Office for Personal Data Protection.

8.7 Buyer assumes risk of changed circumstances (§1765 Civil Code).

9. Protection of Personal Data

9.1 Personal data processed to fulfill Purchase Contract and GDPR compliance.

9.2 Marketing communications only with explicit consent, withdrawable at any time.

10. Final Provisions

10.1 International elements governed by Czech law. Consumer rights under mandatory law remain unaffected.

10.2 Invalid provisions replaced with closest meaning; other provisions remain valid.

10.3 Purchase contract archived electronically and not publicly accessible.

10.4 Appendix includes sample withdrawal form.
